Earlier this month Aunty mentioned to you that the Federal Trade Commission had busted a spam ring which sent pornography spam from its hidey-hole in Las Vegas.
This particular FTC action was of note because it was the first that was publicly noted to include charges under the McCain Amendment to CAN-SPAM, on which your Aunty worked, and which Aunty likes to refer to as the “vender liability” section, although others call it the “advertiser accountability” section. It boils down to the same thing, as FTC Commissioner Eileen Harrington says: “It’s not just people who push the button to send the spam who can be held liable.”
It’s also the people who are being advertised in the spam, and they are often much easier to find.
The Vegas porn spam was taken down for not adhering to the plain brown wrapper rule, which says that e-mail that is of an “adult” nature must be clearly marked in the subject line as such, among other things.
