Happy Wiretap Day! Big Brother Is Listening

Today is the official deadline for DSL, cable, broadband over power-line, satellite, and all other internet providers to finish up installing FBI approved surveillance gear to comply with the FCC’s interpretation of the Communications Assistance for Law Enforcement Act (CALEA.)

CALEA was passed in 1994 by Congress to help the FBI listen to and record conversations that take place over the internet and other technologies. The law also required phone companies to make their networks easier to wiretap.

However, it’s important to note that CALEA didn’t change the standards that are required for a wiretap to be used by law enforcement. A court order must be obtained or other provisions required by the Patriot Act still must be met for government officers to legally record or listen to any conversations.
