Dish Network and the Last Hurrah

This morning, a report of another workaround developed by Dish Network to avoid paying the fines levied against them has surfaced. This is another, in a long series of attempts to get around the ‘look and feel’ of TiVo, so as to stop infringing TiVo’s rights, and also to avoid that big TiVo payday,

The original suit was filed in 2004, judgement came in 2006, and a stay was granted Dish, soon after, so as to not inconvenience the millions of Dish customers. Then a final decree was given in an appeal in late 2007. Dish was judged infringing and none of the possible changes to their system got around that basic fact.

Right now, without any ruling in their favor, Dish Network owes TiVo $70 million. This could help the always struggling TiVo avoid some troubles ahead, and keep America’s favorite way to record television content, alive.

I have Dish Network and I love the DVR software that it has. I have used the TiVo software at a friend’s house. I didn’t like TiVo. This could have been because I am used to Dish Network’s software. The one thing I really like about Dish Network’s software is the ability to do a 30 fast forward button and 10 rewind button on recorded shows or live shows that have been paused. 30 seconds is the average length of a TV commercial and the ability to quickly skip 30 seconds is great. Most commercials breaks are about 3.5 minutes long so all I have to do is push this button 7 times and I am back into my show.

Doug, the 30 second skip feature is part of the ‘look and feel’ part of this lawsuit - it has always been a part of the TiVo experience.
