Maybe Solomon Wasn’t So Wise…

If you’re going to threaten an institution, it’s generally a good idea to make sure you’re on the right side of the law. If you’re going to threaten a law school, you’d better make sure you’re right and then think twice about it anyway. This administration did neither.

According to the 1996 “Solomon Amendment,” the federal government may deny federal funds to educational institutions if they bar military recruiters from lobbying students on campus. The Amendment was never enforced until Bush came into office.

After being warned that they would be denied funds for refusing to allow military recruiters on campus because they would not accept homosexual students, 25 law schools decided to fight back in court. Yesterday they won their case, as a federal appeals court declared the Amendement unconstitutional because it required Colleges to implicitly endorse an exclusionary policy, therefore infringing on their First Amendment rights.
