Is Comcast Violating Your Rights?

I’ve been hearing a lot about Comcast throteling back folks that have an upstream anything larger than a consumer class web surfer. Chris Pirillo had a good rant about it on his Ustream.TV feed last night. I sure hope he puts that bit of video up on youtube.
Being a Comcast customer active in streaming radio and soon to be video streaming, this topic is near and dear to my heart. Thus far I’ve had no problems.
I also stream from our home in Toronto via Rogers cable. Rogers has a monthly ceiling, but I’ve yet to hit it.
I think it’s time for someone who can document Comcast has cut them back to challenge it in the courts. If one is streaming or transferring information, it’s a violation of your rights to free speech. You payed for the service and they are cutting your free speech short! Maybe the ACLU would back a case like that!

Their excuse might be something along the lines of “No one said you have to use Comcast. You can use whatever ISP you want, but if you’re going to use our ISP, then you’re going to have to obey our rules.”
I really envy those people who have a Fiber Connection…
