A New York State Tax for Downloaded Media?

It seems there is the thought of taxing downloaded music in New York State. According to this download squad article, that and other taxes are being considered. The tax rate on this "digital media downloads" would be 4%.
The Yahoo Tech News Article it refers to also mentions that the tax will target "soda and other sugary drinks" and "The idea is to discourage consumption of high-caloric beverages — health officials estimate a 5 percent drop — and to raise $404 million"! They plan on doing this with a tax rate on those beverages "containing less than 70 percent real fruit juice" of 18%!
18 percent! If I am in New York and they ask me what to drink, my answer will be water. The Download Squad article also mentions that Amazon, and others, are fighting the existing New York State Internet sales tax in court. It is pretty easy to understand why Amazon would oppose such a thing. I am wondering how do the folks at Pepsi and Coke feel about it?
