The "Dancing Baby" beats an Artist with an Identity Crisis

W00t! w00t! w00t!… Seems that sanity has prevailed in this one case at least. A whining baby who seems to have an identity crisis and has lacked a hit song for over a decade has been just lost to a cute, adorable "dancing baby", Holden Lentz. (Source)

Universal had claimed that it was not their responsibility to consider the issue of fair use when issuing DMCA take down notices. The EFF took the case to court claiming that issuers of take down notices have an obligation to consider fair use before they issue a notice. (That is that common sense part I mentioned earlier.)

Seems out legislators were too busy counting lobbying contributions from the entertainment industry or are just too ignorant on matters tech (you decide) to cover this particular point in the DMCA. This means that the court has to rule on it. Well, good news for parents who want to share their children dancing to a popular song (well it was in the 80’s), for the courts have ruled that issuers of take down notices must consider fair use!
