IBM Gets Nasty

And it’s a beautiful thing! The GPL will finally be tested in court as IBM has requested partial summary judgement in the SCO lawsuit, this time claiming SCO has copied 783,000+ lines of code from IBM properties.

They are also seeking an injunction against SCO distributing software on the grounds that they have renounced the GPL. Because Linux is covered by the GPL, SCO shouldn’t be allowed to to sell/distribute it, much less demand license fees for it.

This is huge, and obviously the result will have major impact (for good or evil) on Linux and other Open Source software packages. The legal experts appear confident the GPL will come out on top, and I’m sure IBM’s legal team is good at what they do. Here’s looking forward to good news for free (as in speech) software in the coming days!
