The Supreme Court today 06/26/08 struck down the DC gun band and upheld the 2nd amendment with the finding that the “individual” has the “right” to keep and and bare (own) arms and that right “shall not be infringed”.
The vote was 5 to 4
If the vote had gone the other way, it would have started a move by many local governments from across the country to ban ownership and then disarmament of the public.
This would not have been a good thing because as we all know; Thieves on both sides of the fence do not like armed prey.
I note one concern: For a clean showing of intent for the protection of individual rights, the vote would have been 9 to 0. With a vote of 5 to 4, that is one vote away from asserting a truly totalitarian, fascist government that knowingly, willingly, and intentionally wants to “de-claw” a population for increased management, control, and inevitable ease of abuse. .
I’m very pleasantly surprised. It’s almost one of those `great to be American’ days. With our rights falling like blades of grass under the huge lawnmower of government, this is a breath of fresh air. The author makes a very good point about the lack of a lopsided vote though. I haven’t read the dissent yet but I intend to.

I was just reading this on another news brief. I totally agree with your statements here. A vote in the right direction but it should have been 9-0 or 8-1. All these 5-4 votes are starting to make me thing we are really on the brink of disaster.

I suspect we’ve been there for a while. If the wrong justice retires or expires…
