McDonald’s Sued… for Nude Photos

McDonald’s has been sued for many things. Some of the lawsuits have been unique, such as when a customer sued for dangerously hot coffee. However, this may be the first time that the fast food chain has been sued for nude photos:

“A US couple is suing McDonald’s for $3m (£2m) after nude photos of the woman, which were on her husband’s mobile phone, ended up on the internet.

Phillip Sherman says he accidentally left his phone, with the photos, at a McDonald’s in Fayetteville, Arkansas.”

It seems that the owner of the cell phone is blaming McDonald’s. Is there privacy for lost property? There is international press attention because of the nature of the photos. However, the more salient question is whether there is legal protection for lost property or whether the owner of the cell phone is responsible for safeguarding that cell phone and its content.

Sounds like maybe if that content may require a password be set on the phone. Maybe. . . .

I would think this falls under the “they got money, if they settle we get some of it” type of lawsuit. The RIAA sued masses not because they were guilty but because they could collect settlement money.

I can’t see this cell phone issue being any different. Maybe it is just me but when I go visit Ronald, I am not expecting cold coffee or some guy shouting “hey idiot! you left your unlocked cell phone with nude pictures of your wife on the table!”

I will settle for hot coffee, taking accountability and responsibility for my actions and a “would you like fries with that?” I bet the employees are trained to ask that just in case the customer is too thick to think McDonald’s would sell fries.

Ugh, hot coffee all over again!

They’ll cite lost and stolen laptops as precedent and quietly settle out of court.
