Parents Homeschooling Their Children May Be Breaking the Law

In a ruling that may have repercussions throughout the homeschool movement, a California court has stipulated specific qualifications for teaching children at home:

“A California appeals court ruling clamping down on homeschooling by parents without teaching credentials sent shock waves across the state this week, leaving an estimated 166,000 children as possible truants and their parents at risk of prosecution.

The homeschooling movement never saw the case coming.”

The ruling has placed many homeschooling children and parents at odds with the law. It sends a clear and unambiguous message to the parents that the courts and legislative officials will determine what is best for the homeschooled children. It does not matter what one’s experience and/or educational background may be. Without teaching credentials, those parents, who are teaching their children at home, are breaking the law.

I’m not sure getting courts involved is the answer but I agree.

Even if a parent was or is a teacher themselves, surely they are not experts in EVERY SINGLE SUBJECT that is taught in school and can’t possibly provide the necessary information their kids would have.

That said, I can understand why a parent might not want to send their kids to public school (and cannot afford private). Today’s kids DO face issues that many parents feel put their children in danger and the local/State govts aren’t helping.

Hmm..very difficult to take sides but the one thing is clear–if there is a law requiring them to go to approved schools and they are not then,I guess, they are breaking the law.

I wouldn’t toss them in jail though..that’s not good for anyone.

There is absolutely no threat to homeschoolers from the proceedings there. One family with a long and documented history of runs ins with child welfare in CA was homeschooling without properly registering their home as a private school in CA. They got caught. They tried to hide behind homeschool laws that don’t exist and the judge called them on it. So now they are crying religious persecution.

The problem is clear that the state of California is simply grabbing for any and all monetary compensation it can. Having children in home school deprives the state of that revenue stream and therefore MUST be deemed illegal so that the government can get its share.

Although most parents are not qualified to teach the children, most teachers are not qualified either. The parents usually lack knowledge, the teachers usually lack desire, as they feel they aren’t receiving enough compensation. At least with parents the effort is made.(As to the efficacy of home schooling, there are many studies showing that home schooled children excel and surpass their standard schooled brethren)

Thankfully, the law here in my state is very clear when it comes to HomeSchooling my daughter. They cannot and will not dictate a “set” curriculum, and it clearly states that I do not have to be a “certified” teacher. I keep extremely detailed records of our lesson plans, as well as keeping all assignments, quizzes, tests, papers, etc. My daughter is getting not only an excellent “book” education, she’s also being exposed to a “real life” one, via field trips we take, community organizations we belong to, and community service work she participates in.

It was only a matter of time before someone in CA would seek to make it illegal to homeschool one’s children. Next week they will be seeking mandatory sterilization of Christians and conservatives who don’t agree with their way of thinking. I mean, you really can’t let productive, moral, hard-working, independent and self-sufficient citizens raise their own children - they might grow up to believe people are actually responsible for their own actions. We can’t have that can we?

As a homeschooling parent and concerned American this action is very scary. People do not see the “problem” with government trying to control all aspects of our life. In Georgia the government schools are trying to make it mandatory to have your child weighed twice a year because the parents can’t control their own child’s weight. If a bruise is found on a child the teacher is required to report to the children’s welfare service. Competition has been deemed wrong for the fear that one child may be better than another. Passing and failing grades have given way to S’s and U’s. Awards for achievements are politically incorrect because some children will not receive them. Not all children are the same or equal in their ability to learn and achieve. Simple children’s games like tag have been ruled illegal for the fear of lawsuits for sexual harassment. Children have been expelled for the drawing of an army man with a gun. A child can be arrested and forced into drug programs for having an aspirin in their possession. The pregnancy rate, drug problems, and violent behavior found in government schools is prevalent and a huge problem. School teachers have been reduced to glorified babysitters. Their hands are tied when it comes to the education of our children for the fear that someone might get their feelings hurt for not passing or accomplishing as much as the next child; their school losing government money for not performing as well as other schools; losing their job for not keeping parents happy by passing “their” child; frivolous lawsuits on and on. Today’s school child is not held responsible for their own actions. The disciplinary action has been removed for the fear of lawsuits and job termination. With the resources and support available today any person willing to put the time and love into their child can homeschool. Most homeschool families “give up” a second income to homeschool and all still pay government school taxes. Many sacrifices are given to provide a good, loving, education to a home schooled child but government control of our child from birth should not be one of the sacrifices. Why would a person want the government to educate and control what a child learns and does? Parents no longer want or take the responsibility of raising children. Our country was built on freedom from government control and we are getting further and further from that basic right
