Blockbuster and MPAA decide to hassle user for domain name

Blockbuster video decided they were going to start and online video site. But someone currently owns the domain name blockbustertv.com they figure by hassling the user threatening lawsuits and even bringing the MPAA into the argument maybe he’ll just give up the domain name.

But this user decides to stand his ground taking practically everything they throw at him. Their excuse for the lawsuit is the users might get confused between blockbustertv.com and blockbuster.com.

My question is how are you going to get confused they are two completely different websites. Everybody knows that the blockbuster logo is blue and yellow. The site blockbustertv.com does offer video content as well as many other things. But it is a FORUM. How is someone going to get confused between a forum and an actual website.

Blockbuster continues to hassle the user about the domain name till this day. The MPAA threatened fines for all copyrighted content.

Here is a list of their demands below. I think it’s pretty ridiculous that they have to go this low to attack a person owning a single site a forum at that. Above all it’s non-profit.

Accordingly, we require that you immediately undertake as follows:
1. That you, your business, and any related concerns, shall immediately discontinue all use of the BlockbusterTV trade name and the BLOCKBUSTERTV and BLOCKBUSTERTV.COM trade-marks, and that you, your business, and any related concerns, shall not, at any time in the future, be it directly or indirectly, use the the BlockbusterTV trade name, the BLOCKBUSTERTV and BLOCKBUSTERTV.COM trade-marks, or any trade name or trade-mark confusingly similar with the BLOCKBUSTER Trade-marks;

2. That you shall remove all references to the BlockbusterTV trade name and the BLOCKBUSTERTV and BLOCKBUSTERTV.COM trade-marks from your website located at blockbustertv.com, as well as from any other website that you operate and/or control, be it directly or indirectly;

3. That you will immediately transfer blockbustertv.com to Blockbuster, as well as any other domain names that you own or control, be it directly or indirectly, that are comprised of, or contain, the BLOCKBUSTER Trade-marks, or any term confusingly similar thereto;

4. That you will unlock blockbustertv.com and provide the authorization code for the domain name; and

5. That you, your business, and any related concerns, shall not, at any time in the future, register, adopt and/or use any domain name comprised of, or containing, the BLOCKBUSTER Trade-marks, or any term confusingly similar thereto;

6. That you shall immediately destroy all promotional materials and advertisements bearing the BlockbusterTV trade name, the BLOCKBUSTERTV and BLOCKBUSTERTV.COM trademarks and blockbustertv.com domain name, or any trade name, trade mark or domain name confusingly similar with the BLOCKBUSTER Trade-marks, within your possession, power or control, or which may come into your possession, power or control.

Now blockbuster is a pretty big corporation so who do you think will win the lawsuit? If you have any ideas or suggestions for the admin his website is still up and you can post comments on his forum. here

I’m sure they figure that by threatening court action, they can start a process where the small website will have to try to keep up with their law firm, and may eventually give up the domain just to stop the hassle.

Sometimes people do get web site names confused, and BB knows it, and that may be why they want it.

If BB wasn’t interested in the name until now, and now they suddenly want it, they should have to pay him for it. After all, the phrase “block buster” was already a relevant part of the language before the BB company came along. If he’s using the domain, and not just holding it for ransom, then he should be paid to let it go.

I’m sure there’s a whole section of case law regarding how trademarks cross over to web usage, but I don’t know how its been going, so couldn’t guess who would win the actual lawsuit.

I completely agree, I believe he stated he has owned the domain name for 10 years attempting to get a good user base. He has around 32,000 registered users I believe.

Earlier when I visited, he had about 1,500 active members. So maybe they could work out some sort of agreement.

The thing comes down to blockbuster trademark,and as far as I knew you aren’t supposed to be able to patent an everyday word.

Which blockbuster did such that.
